Does every US client payment face 30% withholding?
No.
The
30% rate is a statutory withholding rate that can apply to certain US-source income unless an exemption or reduced rate applies.
It is not accurate to say that every service payment made by a US client to an Indian freelancer automatically loses 30%.
The treatment can depend on the
type and source of income, where services are performed, whether the income is effectively connected with a US trade or business, treaty provisions, and the payer's documentation requirements.
That is why W-8BEN should not be completed using a generic treaty article or percentage copied from another person's form.
Can W-8BEN reduce withholding for Indian freelancers?
Potentially, where the payment and taxpayer qualify for treaty benefits.
India and the United States have an income-tax treaty, but the applicable article and rate depend on the nature of the income and facts of the engagement.
If Part II of W-8BEN is being used to claim treaty benefits, confirm the correct treaty provision and conditions before entering a rate.

- reference number, where applicable
- date of birth
For an Indian individual,

What documents do you need for W-8BEN?
The form itself does not require every freelancer to attach a fixed bundle of documents.
However, it is useful to have
PAN details, identification, your current address, contract or statement of work, income details, tax-residency information, and any previous W-8BEN.
The payer may request additional supporting information under its own compliance procedures.
Generally, Form W-8BEN remains valid from the date it is signed until
31 December of the third succeeding calendar year.
For example, a form signed in
2026 would generally remain valid through
31 December 2029, unless a change in circumstances makes information on the form incorrect.
What are common W-8BEN mistakes?
Avoid:
- using W-8BEN for a company or other entity
- entering a treaty article copied from another person's form
